  • Transferring property out of one party’s name to that of a relative or friend;
  • Stashing an art collection or other valuable personal belongings with a friend and then claiming that they do not exist;
  • Withdrawing large sums of money and placing them in a different location under someone else’s name; and
  • Making expensive purchases in hopes of making a profit by reselling the items after the divorce is finalized.

Non-Marital Assets 

All assets and property accumulated during a marriage are considered community property and as such are subject to equitable division. However, assets that are acquired prior to marriage are treated as separate property and will remain in the sole possession of the original owner. Gifts received by one spouse, as well as inheritances are also not treated as marital property, as long as they are not commingled with the assets of the other spouse.
