Fort Lauderdale Prenuptial & Postnuptial Agreements Attorney

No matter how many or what type of assets a couple acquires during marriage, deciding who gets what upon divorce can be complicated. Entering into a prenuptial or postnuptial agreement can help avoid this burden, and give spouses significant peace of mind knowing how their property, income and inheritance plans will be handled in the event of divorce or separation. At the Fort Lauderdale offices of Sandra Bonfiglio, P.A., we help clients prepare sound agreements that simultaneously protect their interests and honor their relationships. Prenuptial Agreements

A prenuptial agreement is a contract between two people who are about to be married that spells out how assets will be distributed in the event of divorce or death. It is wise to have a prenup if you fall into any of these categories:

  • One of you is much wealthier than the other
  • You are coming into the marriage with assets, such as a home, stocks or retirement funds
  • You are a business owner
  • You have children or grandchildren from a previous marriage
  • You have relatives that need to be taken care of, such as elderly parents
  • You are pursuing a degree or license in a lucrative profession

While talking to your soon-to-be spouse about a prenuptial agreement may be difficult, remember that a marriage is a financial union, as well as an emotional one. Accordingly, the financial security and protection provided by a prenup may work to strengthen, rather than weaken, your relationship.

Postnuptial Agreements

As the name indicates, postnuptial agreements are created after a marriage has begun. When married couples have concerns about finances or asset protection, voluntarily entering into a postnuptial agreement can put an end to worry and anxiety by addressing one or both spouses threatened financial security. Like prenuptial agreements, they can provide the means of knowing exactly what would happen in the case of a divorce and how both spouses would be able to support themselves.

Because Florida law does not provide for formal legal separation, postnuptial agreements can also be useful in situations where a couple wants to live apart, but does not want to divorce. The postnuptial agreement can set forth terms for maintaining the relationship.
