Using a Divorce Mediator in Fort Lauderdale

Every divorce is different. What works well for one couple may not work well for another. At Sandra Bonfiglio, P.A. we listen to your concerns, answer your questions, and help you find the right approach for your divorce—whether it involves Fort Lauderdale divorce mediation, collaborative divorce, a negotiated settlement, or a courtroom trial.

Is divorce mediation right for you?

During divorce mediation in Fort Lauderdale as well as Florida, a mediator acts as an impartial third party to help you and your spouse reach consensus. For mediation to work, you and your spouse must be open to discussing matters. There must be a give and take, along with a willingness to arrive at an agreement.

Some divorces are so emotionally heated that rational discussion is not possible. Neither spouse should feel intimidated, stifled, dominated, or threatened by the other spouse during mediation. In cases that involve domestic violence, drug addiction, or criminal conviction for violent offenses, mediation may not be the right approach to dissolving the marriage.

How can mediation help you?

Mediation allows you and your spouse to arrive at your own decisions and jointly plan for the future. Every marriage has its own unique circumstances. A court judge is not likely to understand what makes your divorce different and usually hands down rulings based on set standards applied to all cases. Through mediation, however, you can tailor agreements to meet both of your needs.

You avoid the adversarial nature of a trial, appearing in court, and following formal legal procedures. Courtroom trials often fuel the fires of already existing conflicts. In contrast, mediation searches for common goals and ground so a couple can agree. Through mediation you can make arrangements for child custody, child support, property division, and alimony (in certain cases).

How does time and cost for mediation compare with litigation?

Mediation usually consists of a number of sessions and many couples can resolve their issues within a few months. Complicated cases may take up to six months. By comparison, courtroom trials can go on for numerous months or even years. In most cases, the expense of a complex trial is many times greater than what mediation costs. Largely because of time and expense, the greatest percentage of couples settle divorce issues outside of court.
